By accessing or using the Athlete Engineering web application ("Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you must not use the Service.

2. Description of Service

Athlete Engineering provides an AI-based coaching platform that offers personalized training plans, workout feedback, and performance tracking for athletes. The Service is accessible through our website and mobile applications.

3. Eligibility

To use the Service, you must be at least 18 years old and capable of forming a binding contract with Athlete Engineering. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

• Registration: To access certain features, you must register for an account. You agree to provide accurate and complete information during registration and keep your account information up-to-date.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Use of the Service

• License: Athlete Engineering grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.
• Prohibited Conduct: You agree not to use the Service for any unlawful purpose or in any way that could harm the Service, Athlete Engineering, or any third party. Prohibited conduct includes, but is not limited to, unauthorized access, data mining, and distributing viruses.

6. User Content

• Ownership: You retain ownership of any content you upload or submit to the Service ("User Content").
• License to Athlete Engineering: By submitting User Content, you grant Athlete Engineering a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content in connection with the Service.
• Prohibited Content: You agree not to submit any User Content that is unlawful, offensive, or infringes on the rights of others.

7. Privacy Policy

Athlete Engineering does not warrant that the Service will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Athlete Engineering shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; or (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party.

11. Indemnification

You agree to indemnify and hold harmless Athlete Engineering, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

12. Modifications to the Service and Terms

Athlete Engineering reserves the right to modify or discontinue the Service at any time without notice. We may also modify these Terms from time to time. If we make material changes to the Terms, we will notify you by email or by posting a notice on our website. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of California, without regard to its conflict of law principles.

14. Dispute Resolution

Any disputes arising out of or in connection with these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Los Angeles, California.
